I think you're arguing the difference beteen coercion and compulsion. Nobody put a gun to the plaintiff's head; nonetheless, the threat of termination can be a powerful weapon against someone with no other means of support. Was the nurse compelled to particpate? No, she could have refused and accepted the consequences of being fired--loss of food, shelter, insurance, and difficulty getting hired elsewhere. Unpleasant, but survivable. But she was coerced in that strong pressure was put on her to comply, and her religious freedom was certainly violated. One wonders if the hospital has gotten away with this before. The possibility that they may soon be able to do it with impunity is frightening.
